Beginning July 1, 2026, each public and nonpublic school may keep epinephrine on site. Schools are encouraged to store it in at least two unlocked, secure spots, like the office and cafeteria. A doctor can prescribe epinephrine in the name of the school or district. A school nurse or trained staff may give the school’s epinephrine to a student having anaphylaxis when the student has no personal dose or no prescription on file. They must follow a standing protocol from a licensed physician.
Beginning July 1, 2026, state law replaces the words “epinephrine auto-injector” with “epinephrine.” This focuses on the medicine, not a single device type, and can allow different approved ways to give it under that statute.
Starting July 1, 2026, a school nurse or trained employee is not liable for student injury from giving the school’s epinephrine, unless they acted with intentional disregard for safety. This protects staff who follow the school’s standing protocol during emergencies.
Starting July 1, 2026, a doctor who prescribes epinephrine to a school or district is not liable for student injuries from that medicine, unless the doctor issued the prescription or protocol with intentional disregard for safety. This lowers legal risk and can support school access to epinephrine.
