New crime for following to steal cash

Beginning July 1, 2026, Tennessee makes a new crime. It is illegal to knowingly travel the same path as someone, without a real detour, with intent to steal that person's cash from a commercial business or a financial institution, while carrying two or more criminal instruments. The base offense is a Class A misdemeanor. It becomes a Class D felony if, during the act, the person also commits a crime in Title 39, Chapter 13, Part 10. It becomes a Class B felony if the person also commits a crime in Title 39, Chapter 13, Part 4. A 'criminal instrument' is an otherwise legal item made or used to help commit an offense under Title 39, Chapter 13, Part 10 or the state theft law (§ 39-14-103).
