New crime for following to steal cash

Beginning July 1, 2026, the law makes it a crime to knowingly follow someone on the same route to steal their cash from a store, financial institution, or ATM. The person must also carry two or more criminal instruments. A “criminal instrument” is an item not illegal by itself but made or used to commit certain crimes, including the general theft law (§ 39-14-103) or crimes in Title 39, Chapter 13, Part 10. The offense is usually a Class A misdemeanor. It becomes a Class D felony if the person also breaks a law in Title 39, Chapter 13, Part 10 during the offense, or a Class B felony if they also break a law in Title 39, Chapter 13, Part 4.
