A data center can buy electricity, capacity, and related services from a Tennessee independent power producer. The producer can connect behind the data center’s meter; if the data center also takes utility service, it needs the utility’s written approval. The producer may use utility or TVA lines on terms set by the owner, and federal law and TVA rules still apply. An independent power producer is not treated as a public utility just for these sales.
The law stops cities and electric utilities from paying for electric upgrades that only serve a data center. A utility can count part of those upgrades as general system work only when the upgrades also serve other customers, keep service to current customers, are tied to repair or replacement of lines first paid by someone else, and follow the utility’s standard policies. A utility can reimburse a data center only under normal, non‑exclusive rules that treat similar customers the same and do not raise existing customers’ rates. Cities and utilities are not liable for refusing to honor deals that this law makes void.

SB 1748 — AN ACT to amend Tennessee Code Annotated, Title 55 and Title 65, Chapter 15, relative to commercial driver licenses.
SB 2690 — AN ACT to make appropriations for the purpose of defraying the expenses of the state government for the fiscal years beginning July 1, 2025, and July 1, 2026, in the administration, operation and maintenance of the legislative, executive and judicial branches of the various departments, institutions, offices and agencies of the state; for certain state aid and obligations; for capital outlay, for the service of the public debt, for emergency and contingency; to repeal certain appropriations and any acts inconsistent herewith; to provide provisional continuing appropriations; and to establish certain provisions, limitations and restrictions under which appropriations may be obligated and expended. This act makes appropriations for the purposes described above for the fiscal years beginning July 1, 2025, and July 1, 2026.
