Harsher sentences for second-degree murder

The law requires at least a Range II sentence for people convicted of second-degree murder under subdivision (a)(1). Judges may give a Range III sentence when appropriate. A sentence for this crime cannot be lower than Range II. This rule overrides the usual sentencing ranges in Title 40, Chapter 35 for this offense. The law takes effect July 1, 2026, and applies to acts committed on or after that date.
