Beginning July 1, 2026, if you install an EV charger, you must protect your condo association or HOA from all claims tied to the charger, including their reasonable attorney’s fees. The association can require you to buy and keep insurance and list the association on the policy. The association is not responsible for maintaining your charger or the vehicle that uses it; you pay for upkeep.
Beginning July 1, 2026, if you own a condo or a home in an HOA, you can install an EV charger on your own property, including your assigned parking spot. The association cannot ban that, but it can set reasonable limits on number, size, placement, and how it is installed on exteriors. The association may ban chargers in shared common areas, but it cannot ban one in your designated parking spot even if that spot is in a common area.
The law takes effect July 1, 2026. It applies to actions taken, and to HOA declarations made, renewed, or amended, on or after that date. Owners and associations follow these new EV charger rules starting then.

SB 1748 — AN ACT to amend Tennessee Code Annotated, Title 55 and Title 65, Chapter 15, relative to commercial driver licenses.
SB 2690 — AN ACT to make appropriations for the purpose of defraying the expenses of the state government for the fiscal years beginning July 1, 2025, and July 1, 2026, in the administration, operation and maintenance of the legislative, executive and judicial branches of the various departments, institutions, offices and agencies of the state; for certain state aid and obligations; for capital outlay, for the service of the public debt, for emergency and contingency; to repeal certain appropriations and any acts inconsistent herewith; to provide provisional continuing appropriations; and to establish certain provisions, limitations and restrictions under which appropriations may be obligated and expended. This act makes appropriations for the purposes described above for the fiscal years beginning July 1, 2025, and July 1, 2026.
