Beginning July 1, 2026, if you install an EV charger, you must protect the association from all claims and related attorney’s fees tied to the charger. Your HOA or condo association may require you to carry insurance and name the association on the policy. The association is not responsible for maintaining your charger or your electric vehicle. You pay for upkeep and repairs.
Beginning July 1, 2026, HOAs and condo associations cannot ban you from installing an EV charger for your personal use on your own property, including your designated parking spot. They can set reasonable rules on the number, size, placement, and how you install a charger on the exterior of your property. They may restrict chargers in common areas, but they cannot prohibit one in your designated parking spot even if it is in a common area. This law applies to actions and HOA declarations made or changed on or after that date.
