New rules for online cold med sales

For online or remote sales starting July 1, 2026, sellers must get a government ID and confirm the buyer’s name, ID number, and home address in the tracking system. Sellers must check daily, 30‑day, and yearly limits and block the sale if limits would be exceeded. Orders can ship only to the buyer’s residential address on the ID. No delivery to P.O. boxes or commercial mail receiving agencies.

New pharmacist rules on cold med sales

Starting July 1, 2026, pharmacists and interns are no longer required to counsel buyers on why they need the product. The law also removes the explicit right to refuse a sale believed not for a legitimate medical need. Pharmacist‑generated prescription orders under §63‑10‑206 are covered by the same tracking and sale rules as other orders.

Stronger stop sale checks for precursors

Beginning July 1, 2026, pharmacies must send buyer info to the state system before selling pseudoephedrine or ephedrine. If the system issues a stop-sale alert, the sale does not go through. The TBI updates the system at least every seven days with people on the meth registry, and the system blocks their nonexempt purchases. When TBI removes a person from the registry, that person is taken out of the system and can buy nonexempt products again.

Pharmacies must use state tracking system

Starting July 1, 2026, Tennessee pharmacies that sell these products must have and use equipment to access the state’s tracking system. The system is free to pharmacies, and those that follow the rules get civil immunity unless they act negligently, recklessly, or worse. If the system stops being used, pharmacies must switch to the Tennessee Methamphetamine Information System once free equipment is provided. Only law enforcement, healthcare professionals, and pharmacists can use the data, and only to control these sales. The law also defines who counts as a pharmacy under these rules, including internet sellers under Title 63, Chapter 10.

Fees on makers of cold medicines

Beginning January 1, 2027, manufacturers of ephedrine or pseudoephedrine products sold in or into Tennessee must pay monthly fees to the tracking system administrator. The administrator sets fees each year. Fee increases of 10% or more in a year are not allowed unless the administrator shows the rise is due to higher costs, like labor or materials.
