Law enforcement agencies other than sheriffs may sign federal immigration-enforcement agreements without local governing body approval. These agreements must follow federal law, require training for each officer as the agreement specifies, and allow enforcement to the full extent federal law permits.
Each POST-certified county sheriff must sign a federal immigration-enforcement agreement by January 1, 2027. The deal can be the jail enforcement, warrant service officer, task force, or tribal task force model. Local governing bodies cannot block it. The state may withhold all funds to the sheriff’s office or its local government if the sheriff does not comply. A sheriff may pause the agreement during an emergency with prompt notice to the chief immigration enforcement officer and the commissioner of safety. Constables are exempt. This mandate ends on February 1, 2029.
The board must set a rule for people held under 287(g) agreements. Detainees must be transferred to ICE no later than 48 hours, not counting weekends and holidays. The board reviews and reapproves the rule each year. Jails may exclude these short-term detainees from capacity and staffing counts. Sheriffs must keep verifiable records of each detainee’s scheduled ICE transfer date and show them during inspections or audits. These requirements end on February 1, 2029.
