Findings and conclusions of a healthcare quality improvement committee stay confidential. Providers do not have to share them in court, agency, or other proceedings. If another state or federal law requires disclosure, they share only to comply, and privilege is not waived. The act takes effect when it becomes law.
The law defines an adverse healthcare incident as a death or injury tied to care. After such an incident, a provider or hospital may invite you to an open discussion. If you are a minor, your guardian must join. If you cannot take part or died, a family member or legal representative may join. You must sign a written acknowledgment after the incident and before the talk. Only involved people and their representatives can join unless you agree to others. What is said, and notes made for the talk, are confidential, not an admission of fault, and cannot be used in court. Sharing information with you in good faith does not waive confidentiality for quality improvement materials.
