The law gives celebrities a legal shield when they endorse an alcohol brand or a licensed bar or restaurant. They are not liable for injuries or deaths caused by the brand, the establishment, or their workers and agents. The shield does not apply if the celebrity sold or supervised the sale, owns any part of the business, runs it, or was the proximate cause of the harm. Endorsement pay and common approval rights (marketing, menus, décor, taste, and appearances) do not count as owning or running the business.
A celebrity must be at least 21 and a U.S. citizen to sign an alcohol endorsement. They cannot be a TABC member or employee, or a public official or public employee, except unpaid municipal appointees whose boards do not oversee alcohol. They must have no alcohol-law offenses in the last 10 years (and not have worked with others to break those laws), no felony involving moral turpitude in the last 10 years, and never have had an alcohol license revoked for cause. If a celebrity gets 5% or more of drink-sale proceeds, the Commission can require ID and a questionnaire, and those records and the agreement are not public under § 10-7-504(a)(24).
