If an applicant asks, the governing body must keep the person’s application materials confidential during hiring. If that applicant is selected, the interview (if recorded) and application become public records available by request. If not selected and the applicant asked for confidentiality, the materials and interview stay confidential. These rules apply to director-level positions defined in the law.
The law lets governing bodies hold private executive sessions to interview applicants for director-level jobs. They do not have to give public notice for these interview sessions. Only governing-body members, invited staff, and the applicants may attend. The minutes must list everyone present, but do not name the applicants being interviewed. The body cannot deliberate or vote in private. All discussion and any vote must happen in a public, noticed meeting. Director-level means a leader who runs a department or division and is chosen by the mayor, by the governing body, or by the mayor with confirmation. It excludes the chief of police.

SB 1748 — AN ACT to amend Tennessee Code Annotated, Title 55 and Title 65, Chapter 15, relative to commercial driver licenses.
SB 2690 — AN ACT to make appropriations for the purpose of defraying the expenses of the state government for the fiscal years beginning July 1, 2025, and July 1, 2026, in the administration, operation and maintenance of the legislative, executive and judicial branches of the various departments, institutions, offices and agencies of the state; for certain state aid and obligations; for capital outlay, for the service of the public debt, for emergency and contingency; to repeal certain appropriations and any acts inconsistent herewith; to provide provisional continuing appropriations; and to establish certain provisions, limitations and restrictions under which appropriations may be obligated and expended. This act makes appropriations for the purposes described above for the fiscal years beginning July 1, 2025, and July 1, 2026.
