Both the Utilities Board and City Council must approve electric, water, and sewer rates. Rates must cover operating and maintenance costs, debt, and needed reserves. No free utility service is allowed for the City, any department, or any customer. Money from utility bills can only fund utility costs, debt, upgrades, a working cash fund, and related needs. The utility may send the City a payment in lieu of tax up to 100% of the real estate tax on utility property, and pay any legally owed taxes.
The law takes effect in Winchester only if two‑thirds of the City’s legislative body approves it. The presiding officer must proclaim and certify the result to the Secretary of State. Without two‑thirds approval, the law does not take effect locally.
The law creates a five-member Utilities Board for Winchester. The Mayor is a member; four resident voters serve staggered four‑year terms so one seat ends each August 31, and at least one current City Council member must serve. Vacancies are filled by Mayor nomination with City Council approval. City Council may remove a member for cause by a three‑fourths vote. City Council sets Board pay by ordinance. The Board must submit a budget by May 30; both bodies must approve a balanced budget by June 30, and any changes need both approvals. City Council may have the Board bill and collect city fees in a separate fund, and sets the no‑bid purchase limit by ordinance.

SB 1748 — AN ACT to amend Tennessee Code Annotated, Title 55 and Title 65, Chapter 15, relative to commercial driver licenses.
