Beginning September 1, 2025, Texas sets rules for transportation protection agreements that pay to transport a deceased person’s body. They cover transport from the place of death to a licensed holding facility or licensed crematory. The death must occur more than 75 miles from the licensed facility that will provide funeral services. These agreements are excluded from the state’s definitions of prepaid funeral benefits and funeral service. Qualifying agreements sold by sellers are not insurance and are exempt from Texas Insurance Code requirements.
