Beginning September 1, 2025, Texas officials cannot count a caregiver’s refusal to affirm a child’s gender identity or sexual orientation as abuse or neglect. This applies to people responsible for a child’s care, custody, or welfare. It includes refusing to use the child’s preferred name or pronouns, even after a legal name change. The exclusion protects caregivers from findings based on these refusals and limits the grounds for child protection action.
