Covered Texas colleges can provide or seek name, image, and likeness payments for prospective athletes. Student athletes can sign deals involving college payments, payment for accepting admission, or acts during official team activities. Existing limits remain unchanged: athletic-performance payments, specified endorsements, conflicts with school or team requirements, contract length, and school property use without permission. The changes cover payments made on or after the law’s effective date; earlier payments follow prior law. The effective date is approval with a two-thirds vote of elected members in each house; otherwise, September 1, 2025.
Covered colleges and other specified parties can follow conflicting requirements from sports organizations with authority over their programs. They can also follow conflicting final court orders that apply to those organizations. This permission applies only to the conflict; the organizations’ rules, including enforcement rules, still apply.
People, businesses, and organizations—including covered colleges—cannot make name, image, and likeness deals with prospective athletes under 17. The ban also covers deals with those athletes’ relatives by blood or marriage. It does not apply when the athlete is enrolled at a college or university.
