For estimate requests made beginning September 1, 2025, Texas facilities must explain the federal billing dispute process in their estimates. This notice covers patients eligible under 45 C.F.R. Section 149.620 whose final charges exceed the estimate by $400 or more. A facility that violates the estimate rules cannot take or help third-party collection actions, report the patient to a credit bureau, or sue the patient. The appropriate licensing agency can also enforce these rules.
For requests made beginning September 1, 2025, Texas health care facilities must email written estimates within five business days. Patients can request estimates before scheduling elective inpatient admissions, nonemergency outpatient surgery, or other nonemergency elective services. Estimates must show total expected facility charges. Facilities must warn that requesting an estimate may delay scheduling and actual charges may vary with medical condition and other factors. They must explain that billed charges may differ from what patients or insurers pay, and insurance coverage determines personal liability. Patients must be advised to ask their health plan about its structure, coverage, deductibles, copayments, coinsurance, and other payment rules. The law repeals the former price-estimate rules in Subchapter B of Chapter 324. Requests made before September 1, 2025, remain under the old law.
