Beginning September 1, 2025, Texas law limits gun-information requests by the Health and Human Services Commission, Department of Family and Protective Services, and child-placing agencies contracting with the department. These agencies cannot require agency foster homes to identify specific gun types or report changes in those types. They may use gun-type information only to determine whether guns are present in the home. Gun-type information is confidential and cannot be released under Texas public-information law. A child-placing agency that breaks the use restriction owes the state up to $5,000 per violation; the attorney general may sue to collect.
