Payment deadlines and appeals for appointed lawyers

The law covers Texas lawyers appointed to represent people who cannot afford counsel in criminal and juvenile cases. It applies to expenses incurred on or after September 1, 2025. County fee schedules must set reasonable fixed rates or minimum and maximum hourly rates, considering overhead and available qualified lawyers. Payment requires an itemized service form and approval from the responsible judge or managed assigned counsel program director or designee. Counties must pay approved amounts under their fee schedules within 45 days after the payment application is submitted. When a judge or director rejects the requested amount, written findings must state the approved amount and each reason for changing it. Lawyers can appeal a rejection or a failure to act after 60 days from submission. The regional presiding judge reviews the appeal, may hold a hearing, and decides the proper payment.
