Texas utilities must list critical public facilities

Beginning September 1, 2025, Texas electric utilities must keep priority facility lists for their retail service areas. Each list must include facility names, types, and addresses. Eligible facilities include those already designated under state law and those whose electric service is crucial to public safety. Examples include hospitals, police and fire stations, critical water or wastewater facilities, and confinement facilities operated by or under contract with the Texas Department of Criminal Justice. Utilities must offer website requests for listing and may add only qualifying facilities. When a facility asks whether it is listed, the utility must answer within 14 days. During a governor-declared natural disaster or other emergency affecting its service area, the utility must send its list to the Texas Division of Emergency Management. Lists sent to that agency are confidential and exempt from public records disclosure. The Texas Public Utility Commission may add processes to protect consumer information.
