Beginning September 1, 2025, Texas groundwater districts can use covered export-fee proceeds only to assess and address groundwater-development impacts. This covers money from fee increases under Water Code Section 36.122(e-1) imposed on or after January 1, 2024. Allowed uses include keeping significantly affected wells working, including wells outside the district. Districts can also fund alternative water supplies, aquifer monitoring, data collection, and aquifer science. Funding well upkeep in another district requires an interlocal contract with that district authorizing the spending.
