Divorce court keeps power over omitted property

Beginning September 1, 2025, Texas preserves the original court’s sole authority to divide property left out of a final decree. This covers courts that issued a final divorce or annulment decree, or another final order dividing marital property. The court keeps this authority despite conflicting rules elsewhere in the same chapter of Texas family law. The change applies to suits pending in trial court on September 1, 2025, and suits filed after that date.
