Higher penalties for profiting from official information

Beginning September 1, 2025, Texas sets higher felony levels for misuse of official information that brings larger net financial gains. The offense generally remains a third-degree felony, including when the offender's net gain is below $150,000. A net gain of $150,000 to under $300,000 makes it a second-degree felony. A net gain of $300,000 or more makes it a first-degree felony. The changes apply only to offenses committed on or after September 1, 2025. If any part of the offense occurred earlier, the prior law applies.
