Texas counties can regulate roadside vendors

Beginning September 1, 2025, qualifying Texas counties can adopt public-safety rules for food and merchandise sales, including live animals. They can also regulate building, maintaining, or placing vendor structures and asking for money. This authority covers public roads, road rights-of-way, and parking lots in unincorporated areas—outside city limits. Counties qualify with more than 1.3 million people, or more than 600,000 next to a county exceeding 4 million. Rules require an order from the county commissioners court; counties do not have to adopt them.
