For covered insurance, insurers must give written reasons when they deny a completed, submitted application, cancel coverage, or refuse renewal. Applicants and policyholders do not have to ask for the explanation. Notices and reasons must meet state legal requirements; electronic delivery is allowed under the state's electronic notice rules. The changes cover applications made or policies delivered, issued for delivery, or renewed on or after January 1, 2026. Earlier applications and policies follow prior law.
Insurers must send or mail written notice when they deny a completed, submitted liability or commercial property insurance application. For commercial insurance, the notice goes to the applicant's agent. The agent must tell the applicant about the denial and make the notice available for review. The changes cover applications made or policies delivered, issued for delivery, or renewed on or after January 1, 2026. Earlier applications and policies follow prior law.
The Texas insurance commissioner can adopt and enforce rules, including notices, for denials of completed applications, cancellations, and nonrenewals. This authority covers insurance regulated under Chapters 5, 1804, 1805, 2171, or 2301, or Title 10, Subtitles C–F. Insurers must report their reasons at least quarterly, using the commissioner's required format. The insurance department must post combined summaries by ZIP code without naming insurers; workers' compensation reports and summaries are statewide. The changes cover applications made or policies delivered, issued for delivery, or renewed on or after January 1, 2026. Earlier applications and policies follow prior law.
