Higher penalties for armed and repeat violations

Beginning September 1, 2025, Texas increases penalties for specified protective-order and bond-condition violations. Possessing a deadly weapon during violations listed in Penal Code Section 25.07(a)(1), (2), (3), (5), (6), or (7) makes them state jail felonies. That penalty also applies after conviction or deferred adjudication when someone violates a Chapter 7B protective order for that offense’s victim. Repeat violations under Section 25.072 become second-degree felonies, rather than third-degree felonies, after at least one instance of the qualifying armed conduct. These changes apply only to offenses committed on or after September 1, 2025; earlier offenses remain under prior law.
