Beginning September 1, 2025, Texas hospitals cannot fire, suspend, discipline, or discriminate against nurses for protected staffing activities. These include sharing information with the nurse staffing committee or reporting staffing violations to hospital management or the state health commission. Nurses are also protected when refusing mandatory overtime or reporting violations of the overtime rules. The law extends overtime protections to mental hospitals, including state-operated hospitals.
Beginning September 1, 2025, each hospital’s chief nursing officer must confirm its staffing reports are accurate. The health department must share those reports with the Texas Health and Human Services Commission. The commission enforces staffing and overtime requirements through existing hospital licensing systems, including those for licensed mental hospitals. Written or spoken complaints receive review and response deadlines, plus written notices explaining decisions, staff contacts, actions, outcomes, and resolution dates. Complaint records remain confidential except for disclosures allowed by the referenced laws. The law requires any needed implementation rules by December 31, 2025.
