Texas insurers offering Medicare supplement coverage to people 65 or older must also offer it to qualifying people under 65. Those younger people must qualify for and have Medicare because of end stage renal disease or amyotrophic lateral sclerosis. The same benefits and protections apply, subject to exceptions under state insurance rules. Supplement Plans A, B, and D must cost the same as for a 65-year-old; other plans cannot exceed twice that rate. These changes apply to plans delivered, issued for delivery, or renewed on or after September 1, 2025.
Qualifying Texans under 65 with Medicare due to end stage renal disease or amyotrophic lateral sclerosis get protected enrollment. Their regular six-month window starts on the first day of their first month enrolled in Medicare Part B. During protected enrollment, insurers cannot deny or condition coverage, require medical review, charge health-based prices, impose waiting periods, or exclude preexisting conditions. People already enrolled in Part B for either condition and under 65 on the law’s effective date can also apply after December 1, 2025, and before June 1, 2026. Those who requested an application during that window but could not apply because it was unavailable get six months from its first availability. The insurance commissioner must adopt rules needed to administer enrollment periods; the changes cover plans delivered, issued for delivery, or renewed on or after September 1, 2025.
