Higher indecent assault penalties for vulnerable Texans

Beginning September 1, 2025, Texas makes indecent assault against a disabled or elderly person a second-degree felony. The Texas Penal Code’s Section 22.04 definitions determine who counts as disabled or elderly. The higher penalty applies only to offenses committed on or after that date. Earlier offenses remain governed by prior law.
