Texas prosecutors gain more county options

Beginning September 1, 2025, Texas expands county options for certain theft and organized-crime prosecutions. Theft of intangible personal property can be prosecuted where the owner lives, the defendant is arrested, or the defendant is extradited. These options also apply to organized-crime cases involving that theft. Organized-crime cases involving Chapter 32 Penal Code felonies can use any victim’s home county, the arrest county, or the extradition county. Organized-crime cases can also use any county where an act advances the criminal activity’s goal. For organized-crime cases involving Tax Code felonies, county options follow the Tax Code’s rules. The changes apply only to offenses committed on or after September 1, 2025. If any element occurred before that date, the former law applies.
