New notice rules for bail sureties

Beginning September 1, 2025, bail bond backers must give notice before filing a sworn statement to surrender a defendant. They must notify the defendant’s lawyer, if there is one, using Texas Rule of Civil Procedure 21a. For a felony under the Texas Penal Code, they must also notify the state prosecutor with authority over the case. The statement goes to the court or magistrate where the case is pending. It must list the court, case number, defendant, charge, bond date, reason for surrender, and confirmation of required notices.
