Beginning September 1, 2025, the Texas Department of Transportation must share proposed wind-measuring tower notices within 30 days after receiving them. Copies go to federally owned or operated radar installations and military aviation training facilities in Texas within 50 nautical miles of the tower. Copies also go to county judges in Texas counties containing those sites or within 25 miles of those sites. A military aviation training facility is a base, station, fort, or camp where U.S. armed forces regularly conduct aviation training.
Beginning September 1, 2025, Texas covers qualifying wind-measuring towers with bases up to 12 feet wide, up from 6 feet. Covered towers stand on their own or use guy wires and anchors, and support equipment that measures wind resources for turbines. Before construction, people erecting these towers must notify the Texas Department of Transportation through its website at least 30 days ahead. They must use the department’s form and provide the owner or operator’s name, address, and contact details. Required site details include latitude, longitude, ground elevation, tower height above ground, and the planned construction start date. The department can require more information about ownership, tower features, or location. Owners or operators must report changes using the department’s required process; the law sets no update deadline. The department must adopt rules for reporting existing or planned towers and registering towers, but the law sets no registration details or rule-adoption deadline.
