These rules apply to construction contracts entered into or renewed on or after September 1, 2025, including related agreements. Clauses choosing another state's law, courts, or arbitration location are void. When a venue clause is void under these rules, lawsuits must be brought in the Texas county containing the property. Parties can agree to another location after the dispute starts. Separate contract-based venue rules do not apply to agreements that were legally unconscionable when made or to these void venue clauses. Those separate rules also do not apply when a Texas statute outside the general venue title sets the location.
