Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Child-serving facilities must screen and train workers

Beginning September 1, 2025, covered Texas facilities must check state criminal records and verify work history for child-contact roles. Covered facilities include state-regulated residential treatment facilities, group homes, juvenile detention facilities, and county or city homeless shelters. The rules cover applicants and current employees, volunteers, and contractors who may care for, supervise, guide, control, or routinely interact with children. Facilities must contact listed past employers when possible; a Human Resources Code Section 42.056 check satisfies the screening requirements. Facilities must also get electronic state police arrest and conviction updates for continuing personnel with direct child contact. Required training covers spotting physical or sexual abuse, reporting duties, facility reporting policies, and appropriate relationships with children.

Child-abuse findings bar facility jobs and secrecy

Beginning September 1, 2025, covered Texas facilities cannot hire or keep employees, volunteers, or contractors when required checks uncover specified child-abuse conduct. These are the covered treatment facilities, group homes, juvenile detention facilities, and county or city homeless shelters. The conduct must constitute an offense under Texas Penal Code Sections 21.02, 22.011, 22.021, or 25.02. Separation agreements entered into on or after September 1, 2025, cannot block disclosure of that conduct to prospective employers. The law does not itself require disclosure.
