New requirements for renewable energy recyclers

Beginning September 1, 2025, Texas regulates facilities that recycle wind turbine, solar energy, and battery storage components to recover materials. Owners must report to the Texas Commission on Environmental Quality by January 15 each year. Reports must list accepted components not yet recycled, including those owned or controlled by the facility, wherever located. They must include a recycling or disposal timeline and a cost estimate from an independent, Texas-licensed professional engineer. With the first report, owners must provide financial assurance covering 100% of estimated recycling or disposal costs. Later reports must include any added assurance needed to maintain full coverage of the updated estimate. Owners can use a letter of credit, bond, or parent-company guarantee with at least an investment-grade rating from a major domestic rating agency. People may accept, process, or repurpose covered components for pay only when they comply with these requirements. The commission can fine facility owners or operators up to $500 per violation, per day. It must also post an online list of Texas facilities that comply with the law.
