Beginning September 1, 2025, Texas expands its harmful-disclosure offense beyond public website posts to electronic communications. It covers sharing someone's home address or phone number with intent to harm or threaten them, their family, or household. The offense is a Class B misdemeanor, rising to Class A if it causes bodily injury to those people. Public servants remain exempt when sharing information while performing their duties as required by or in accordance with law. Earlier offenses remain governed by the prior law.
For offenses committed on or after September 1, 2025, Texas covers retaliatory electronic disclosures as well as public website posts. The person sharing a home address or phone number must know it belongs to a public servant or their family or household member. They must intend harm or a threat of harm because of the public servant's service or status. After receiving the affected person's written safety demand, leaving the information online beyond 48 hours counts as evidence of harmful intent. Reposting it or making it public through another medium within four years also counts, even after the public servant leaves office. This evidence can support prosecution; it does not automatically establish guilt.
