New lawsuits for injuries from advertised vaccines

You can sue a vaccine manufacturer when it advertises a vaccine in Texas and that vaccine causes you harm. This separate right to sue applies despite other laws limiting liability. Only Texas claims that accrue on or after September 1, 2025, qualify. Advertising includes paid media and influencer promotions, but excludes provider-to-patient talks or written materials and vaccine promotions in clinical settings. You must file within three years after your claim accrues, meaning when your legal right to sue arises. If you win, the court must award actual damages, court costs, and reasonable attorney’s fees.
