Restaurant tax break for Texas farm-raised oysters

Beginning October 1, 2025, restaurant owners can deduct $5 from taxable sales for every 100 qualifying oysters purchased. The deduction applies separately to each food service establishment with a sales tax permit issued to that owner. Oysters must be farm-raised in Texas waters under state and federal rules, and bought for preparation and service there. Owners claim the deduction for the year, quarter, or month in which the sale is reported. This reduces taxable sales, not taxes owed by $5; actual savings depend on the tax rate. The Texas comptroller can request information to check deductions and adopt rules to run the program. Tax debts from before October 1, 2025, remain subject to the former law, including collection and enforcement.
