Beginning September 1, 2025, Texas hospitals with a state maternal care designation must offer families bereavement counseling options after a loss. This applies after a baby dies before birth, is stillborn, or dies as a newborn. Hospitals must also offer any available bereavement device, which can slow tissue breakdown for up to 72 hours. These resources must remain available for the hospital stay a medical professional recommends for a birth. Hospitals do not have to provide a device they do not have.
Beginning September 1, 2025, Texas must run an initiative to improve access to and quality of perinatal bereavement care. The health department may give hospitals with a state maternal care designation staff training, devices, device training and maintenance, and other needed resources. It may award grants using appropriated or otherwise available money and accept gifts, grants, and donations. Resource priorities are hospitals without device access, those treating more high-risk maternal patients, and those delivering more babies. The state health commissioner, working with the Perinatal Advisory Council, must also set criteria and run a recognition program for designated hospitals that train staff; recognition does not make training mandatory.
