More oversight of Texas open meetings cases

Beginning September 1, 2025, the Texas Attorney General’s Open Records Division may help investigate Open Meetings Act offenses when law enforcement or prosecutors request help. When an agency sends a prosecutor a report stating probable cause that an identified person committed an offense, it must simultaneously send the division a copy. Investigating agencies and prosecutors must give the division all nonpublic investigation information when the Attorney General requests it. Prosecutors who receive these reports or represent the state in these prosecutions must post notices when declining prosecution or ending investigations. Each notice must explain the decision and its reason and stay on the prosecutor’s office website for at least one year.
