Covered container recycling sites cannot be installed or operated within 2,000 feet of a private home. This applies only to sites that start receiving containers on or after September 1, 2025. Covered sites accept containers regulated by the Pipeline and Hazardous Materials Safety Administration for reconditioning for reuse or disposal. These containers are rigid or flexible portable packaging designed for mechanical handling, holding at least 275 gallons, excluding cylinders and portable tanks. Sites that never stage, store, or process more than 50 containers at once are exempt. The law preserves local governments’ power to adopt the same 2,000-foot restriction.
The law sets registration, inspection, and annual fee rules for covered container recycling sites starting operations on or after September 1, 2025. It covers sites accepting federally regulated intermediate bulk containers for reconditioning for reuse or disposal, with more than 50 containers on site at once. Owners generally must register with the Texas Commission on Environmental Quality at least 30 days before receiving containers. Sites starting before March 1, 2027, do not have to register before March 31, 2027. The agency must inspect registered sites on site at least once every three years to check compliance with its laws. Annual fees cover reasonable registration and inspection costs; the law sets no dollar amount. Fees go to the Water Resource Management Account in the general revenue fund and may fund only this program. Agency implementation depends on specific appropriations; without them, the agency may use other available funds but need not do so.
