New recovery rights for crowdfunding beneficiaries

The law creates a right to sue someone who collects crowdfunding donations for another person intending to keep the money. The intended recipient or their estate can bring the lawsuit. If they win, the court must award 125% of the fraudulently collected donations, plus reasonable and necessary attorney’s fees. They can also seek extra damages to punish the fraud under existing law. This new right applies only to claims that arise on or after September 1, 2025.
