Texas disposal facilities face new permit rules

Beginning September 1, 2025, Texas Railroad Commission permits for commercial surface disposal facilities last no more than 10 years. Holders have the right to apply for renewal within existing permit boundaries, but approval is not guaranteed. Renewal applications are due at least 120 days before expiration. For new permits, the commission may consider the applicant’s compliance history at similar waste facilities when setting permit length. For amended or renewed permits, it may consider compliance at that facility or similar facilities. Evidence includes past inspections, quarterly reports, and other relevant records documented by the commission. These rules apply to permits issued, amended, or renewed on or after September 1, 2025. Earlier permit actions remain governed by the prior law.
