The law takes effect September 1, 2025, and requires implementing rules as soon as practicable afterward. The Texas Alcoholic Beverage Commission must adjust fees for new and renewed certificates, permits, and licenses. It must raise fees as needed to cover its costs of administering the Alcoholic Beverage Code. The law sets no dollar amounts or separate date when higher fees begin.
Beginning September 1, 2025, out-of-state brewers can seek, accept, or fill licensed Texas brewer or distributor orders only as the brand's primary American source. That source must be the brewer, producer, owner when the product becomes marketable, bottler, or an exclusive agent of those parties. It must also be the first source closest to the manufacturer from which Texas brewers or distributors can buy. Each product can have only one primary American source for Texas. That source counts as the brewer under the business relationship rules in Chapter 102, Subchapters C and D.
Beginning September 1, 2025, out-of-state brewers can ship malt beverages from any of their outside locations under one Texas license. Deliveries go only to licensed Texas brewers or distributors, using permitted carriers or vehicles the out-of-state brewer owns or leases. Shipments must use barrels or other containers, not tank cars. Brewers can make contracts to provide brewing services or share brewing facilities, including contracts between out-of-state and Texas brewers. Each party must hold a Texas brewer's license at the brewing location and file the required federal Brewer's Notice and Brewer's Bond. When applicable, parties must also post a bond with the Texas Alcoholic Beverage Commission in an amount it sets.
