Beginning September 1, 2025, Texas child welfare officials must complete a comprehensive assessment within 45 days of entering state custody. It must fit the child's development and include trauma screening and interviews with people who know the child's needs. Commercial sexual exploitation risk screening is required when age-based validation guidelines support it or exploitation concerns exist. Officials must use a validated, evidence-informed tool selected by the state's Child Sex Trafficking Prevention Unit. The Department of Family and Protective Services must implement this rule only to the extent lawmakers specifically fund it. Without that funding, the department may use other money available for this purpose, but implementation is optional.
Beginning September 1, 2025, Texas juvenile probation departments must assess each child's risks and needs before the court's final case decision. This covers every child under a department's jurisdiction. The assessment must use a validated instrument or process provided or approved by the Department of Family and Protective Services. It must include screening for commercial sexual exploitation risk. That screening must use a validated, evidence-informed tool selected by the state's Child Sex Trafficking Prevention Unit.
