Beginning September 1, 2025, the Texas Transportation Commission requires nonstate money before approving aviation project loans or grants. Nonstate sources must cover at least 10% of total project costs, or 5% for airports in economically disadvantaged counties defined by Transportation Code Section 222.053. Each participating local government must keep control of the airport or facility for at least 20 years. Local governments must disclose all funding sources, show they can finance and operate the project, and ensure adequate planning. The law also repeals Transportation Code Section 21.114(b).
