Beginning September 1, 2025, Texas expands access to criminal records for public benefits provider screening. The Health and Human Services Commission and its Office of Inspector General can obtain these records beyond Medicaid. This access covers providers and provider applicants in any public benefits program the commission runs. Checks can cover people whose direct or indirect ownership interests, alone or combined, total at least 5%. They also cover holders of secured-debt interests equaling at least 5% of a provider’s or applicant’s property or other assets. Corporate officers, directors, partners, and managing employees are also covered. Managing employees control operations or directly or indirectly run daily operations for all or part of the provider or applicant. The law does not directly change household benefits or eligibility.
