Texas regulators must set minimum motor fuel quality rules using the latest ASTM International petroleum standards on the sale date. Gasoline, including ethanol blends, must meet current ASTM D4814 standards for its season and region, with listed exceptions. Fuel meter rules must match the latest National Institute of Standards and Technology recommendations when meters are used. State officials or authorized representatives may sample and test fuel where it is stored, transferred, or sold. Testing rules must follow ASTM standards current on the test date; sampling and handling must follow the law’s procedures. Enforcement actions require approval from the executive director or a designee, and orders require notices on each affected fuel dispenser. The law replaces the prior testing and exceptions framework with a new subchapter and repeals Occupations Code Section 2310.202. These changes cover violations on or after the effective date; earlier violations remain under prior law. The act’s effective-date rule provides immediate effect with a two-thirds legislative vote, or September 1, 2025, otherwise.
Fuel sellers get exceptions to gasoline standards, but seasonal and low-emission limits remain. When areas across 99°00′ west longitude have different ASTM D4814 volatility classes, gasoline, including ethanol blends, may meet either class. Gasoline meeting the current ASTM D4814 Driveability Index can qualify by meeting or exceeding vapor-pressure and distillation class AAA, AA, or A. Blends containing up to 15% ethanol by volume get a 1.0 psi vapor-pressure allowance. That allowance excludes sales and offers for sale from May 1 through October 1 in counties with low-emission fuel requirements. Seasonal vapor-pressure rules may extend up to 15 days to distribute existing stocks. New stocks of higher-volatility gasoline cannot be offered at retail before that class takes effect. Vapor-to-liquid ratio requirements do not apply to gasoline or gasoline-ethanol blends. These exceptions do not override state low-emission fuel rules adopted to meet federal law. They cover violations on or after the act’s effective date: immediate effect with a two-thirds legislative vote, or September 1, 2025, otherwise.
