Beginning January 1, 2026, Texas lenders stop sending specified shares of certain loan fees to the state comptroller. Those shares are $1 under Finance Code Section 342.201 and 50 cents under Section 342.308, previously supporting the Finance Commission. This change does not lower borrowers’ fees. Under Section 342.201, administrative fees are capped at $25 for loans above $1,000 and $20 for loans of $1,000 or less. These fees do not count as interest. Under both sections, fees are earned when loans are made or refinanced and are not refundable. Refinancing lenders cannot charge the fee more than once in 180 days; Section 342.201 loans with interest authorized by subsection (e) have a 365-day limit instead. Tax liabilities from before January 1, 2026, remain subject to collection and civil and criminal enforcement under prior law.
