Texas makes refusing to release a fraudulent lien or claim a third-degree felony when the property owner is a public servant. The person committing the offense must know the owner's public servant status. This applies to real or personal property, and the offense remains a Class A misdemeanor in other cases. The higher penalty applies only to offenses committed on or after September 1, 2025. Earlier offenses remain subject to the prior law.
