Texas agencies generally need written consent to share personal details submitted for an occupational license and must keep that consent. Consent is not required when a federal statute or another Texas law requires or allows sharing. Sharing by or with law enforcement for a law enforcement purpose also needs no consent. The rule excludes licenses and permits administered by the comptroller under the Occupations Code. These requirements cover information shared or kept on or after the law's effective date. The law's effective-date rule provides immediate effect with approval by two-thirds of elected members in each house; otherwise, September 1, 2025.
The law expands which personal details Texas state-agency privacy rules cover. These include home addresses, home phone numbers, personal cell numbers, personal email addresses, and driver's license numbers. Emergency contact details and information showing whether someone has family members are also covered. Covered agencies include all branches of state government, state university systems, and public higher education institutions.
