New DNA safeguards for foster children

Beginning September 1, 2025, Texas law limits DNA collection and use by the Department of Family and Protective Services. The rule covers children in the department's managing conservatorship. For any purpose, collecting or using a child's DNA sample requires written consent from the primary caregiver or a court order. That caregiver must be an adult with actual care, control, and possession of the child.
